Most people will at some time or other have walked down a street or entered a public building and noticed that there was a potential hazard obstructing their paths: it could’ve been a cracked or raised pavement, a hole in the road or an unmarked slippery floor. Fortunately most of us manage to spot these hazards and come to no harm. Sadly not all of us are so lucky. If you have slipped in a shop and injured yourself on an unmarked slippery floor, or tripped on an uneven or broken pavement, you may be able to make a compensation claim for any injuries suffered if there is evidence of negligence.  This particular area of personal compensation law can be quite complex, so it’s always best to get the advice of a specialist personal injury solicitor who will be able to offer you professional advise. The duty of a specialist injury solicitor is to explain the process to you, covering every aspect of the case from how long the claim process might take, what costs might be incurred and who will pay these costs.

Slips and trips are some of the most common accidents in Britain, and according to statistics released from the Health and Safety Executive result in broken bones in 95 percent of cases. Those people responsible for the safety of public areas have a duty of care to protect others from injury. Employers, as we know, are already under a duty to comply with health and safety guidelines to prevent accidents, like tripping over wires or slipping on spillages. Well, similar rules apply to councils, restaurant owners, office managers, shop owners, and any others deemed to owe a duty of care to members of the public.

What should you do if you have tripped or slipped in a public area?

If an accident does occur, it is advisable wherever possible to keep a record and take photographs if relevant. You should also take the names and home addresses of any witnesses to the accident, retain any evidence of doctors visited and treatments received, and keep receipts for any injury-related expenses.

It is advisable to contact a personal injury solicitor as soon as possible after the accident as there are strict time limits for dealing with personal injury compensation claims. Slip, trip and fall compensation claims need to be started in court within three years of the accident happening, or within three years of it becoming clear that you were injured as a direct result of the incident.
