Being involved in a car accident, regardless of its severity, is always a stressful event. You have to call the police, file a report, get information from other drivers involved, and communicate with insurance companies. If you have been in an accident with serious personal injury and/or death, you may even need to contact an experienced auto accident lawyer to file a personal injury claim. However, when one of the drivers is uninsured or underinsured, the stress is only compounded.
Florida is a “no-fault” insurance state. Here is how the system works: For the first $10,000 in medical bills and lost wages, your own insurance company will pay no matter who was at fault in the accident. This coverage is called Personal Injury Protection (PIP) coverage and is required on all insurance policies in the state of Florida. If your medical expenses exceed $10,000, the at-fault driver’s bodily injury liability insurance will cover the remaining costs. If you were not at fault whatsoever, your losses should be covered fully.
There can be problems with underinsured and uninsured motorist car accidents. One problem is that the other driver may not carry the required liability insurance. Another problem is that the driver’s coverage may be too low to cover your losses. Florida has one of the lowest requirements in the nation for minimum liability coverage at just $10,000 per person up to a limit of $20,000 per accident. The majority of Florida drivers carry only the minimum required insurance. As you probably know, medical expenses can easily exceed $10,000 for serious injuries requiring hospitalization, surgery, and ongoing physical rehabilitation. The solution to these problems is to carry uninsured motorist/underinsured motorist coverage (UM/UIM) on your own policy. Your insurance will pay if the other driver’s insurance cannot.
Keep in mind, however, that it is the job of the insurance company to pay out as little as possible. You should never accept a settlement from any insurance company without speaking to a Florida car accident lawyer first. If your injuries are serious, or if a loved one died, due to someone else’s negligence, then you should file a lawsuit and get compensation for all of your expenses, including punitive damages, if applicable.
