Criminal Background Checks
>Throughout the past decade, the ease with which a criminal background check can be conducted has expanded vastly. Many employers have taken advantage of online background checks to ensure the hiring of the best employees possible. Regardless of if using a paid or free checking source, the choice to run a background check has been at the employer’s discretion. Recently, several state legislatures have been pushing for mandated criminal background checks for a plethora of different occupations.
Lawmakers in both Delaware and Pennsylvania have proposed legislation to crack down on child sexual predators through the use of mandatory criminal background checks. The PA lawmaker seeks a bill to require such background checks to all agencies involved with children, after several arrests of alleged child predators have been made in his native southeast area of Pennsylvania recently. So far this bill has not shown mobility, although Republican Nicholas Miccarelli of Delaware has been more successful with a similar proposal. Miccarelli hopes to amend an existing Crimes and Offenses Code to include more severe sentencing guidelines for convicts of multiple child sexual abuse offenses. The past June the House Judiciary Committee voted unanimously for his bill.
In the state of Indiana, legislation for obligatory criminal background checks is also being proposed, but here for a different reason. State Sen. Patricia Miller (R) is asking for these background checks to be given to all nurses. The checks would be administered by healthcare employers, who also would have to report any criminal information surfaced to the state licensing officials. Currently, the 120,000 registered nurses in Indiana self-report any criminal history when applying or renewing their licenses.
British Petroleum is currently dealing with the consequences of non-required background checks as they are now caught in a web of finger pointing after one of their oil-spill crewmembers raped a fellow employee. The incident it is believed, could have been avoided had a basic background check been conducted on the convicted employee. Sadly, this type of incident is not uncommon, especially with companies using large quantities of unskilled workers.
